Customer Testimonial Terms of Agreement
By participating in the IngramSpark® Customer Testimonial campaign, you hereby agree to these terms of agreement (the "Agreement") with Lightning Source LLC (“IngramSpark”). I have been informed and understand that IngramSpark is producing advertisements, either in video, digital, or printed form, and that my name, likeness, image, voice, appearance and/or performance may be used to make a part of those creations (the “Work”).
I hereby grant IngramSpark, and its affiliated and subsidiary companies the irrevocable right to use my name (or any fictitious name), likeness, image, voice, appearance, or other information submitted by me in the Work whether recorded on or transferred to videotape, film, slides, photographs, audio tapes, DVDs, print, advertisement, or other media now known or later developed for any purpose at IngramSpark's discretion, and even if only available in a sound only form. This grant includes without limitation the right to edit, digitally enhance or alter, mix or duplicate and to use or re-use the Work in whole or parts of the Work, as IngramSpark may elect. I hereby waive any right to inspect or approve any finished product(s), including written copy or any other products that may be created in connection therewith. IngramSpark may use images or sounds from any video or sound recording to create additional works, including without limitation advertisements, calendars, tablets and IngramSpark shall have complete ownership in all products it creates using any material from the Work in which I appear, including copyright interests.
I grant IngramSpark the right to broadcast, rebroadcast, exhibit, market, sell and distribute the Work, either in whole or in parts, including the creation of any derivative works from the Work, for any purposes that IngramSpark, in its sole discretion, may determine, including without limitation advertising and promotion.
I confirm that I have the right to enter into this Agreement and hereby give all clearances, copyright and otherwise, for use of my name, likeness, image, voice, appearance, and other information submitted in the Work. I expressly release and indemnify IngramSpark and its successors, assigns and/or licensees from any and all claims including, without limitation, any and all claims for invasion of privacy, infringement of my right of publicity, defamation (including libel and slander) and any other personal and/or other property rights, arising out of or in any way connected with the above granted uses and representations. I agree that I shall not now or in the future assert or maintain any such claim against IngramSpark, its affiliated or subsidiary companies, their successors, assigns and/or licensees.
